Abstract
The discussion concerning the possible ways of identifying a child’s mother is complex since, according to Italian law, the woman who gives birth is the child’s mother (Art. 269 paragraph 3 of the Civil Code, Bianca, La riforma della filiazione. Padova: Cedam, 2015), but so is the woman who has a genetic link with the child (Art. 269, paragraph 2 of the Civil Code). Specific precedents are missing, due to the prohibition of surrogacy, but the answers offered by judges when the identification of the mother is questioned, in cases of Artificial Reproductive technique (ART), are contradictory.
