When the article was published, the author did ask to remove the following paragraph under heading 2.2: “In another case, the Paris Court of Appeal dealt with a dispute over the copyright in a photograph taken by a monkey using the photographer’s camera [5]. The court ultimately held that the photograph was not eligible for copyright protection, as it did not meet the originality requirement under French copyright law. The court reasoned that the photographer did not exercise any creative control over the photograph, as he did not select the framing, focus, or other artistic elements of the image. Therefore, the monkey was not considered the author of the work and no copyright protection was granted to the photograph. While not directly related to AI, this case raised questions about the criteria for copyright protection and the ownership of works created by non-human agents.”
