Zusammenfassung

Who killed Article 2(4)?“ – oder in sinngemäßer deutscher Übersetzung: „Wer hat das völkerrechtliche Gewaltverbot beseitigt?“ Der Umgang einiger Staaten mit dieser Norm in der letzten Zeit erweckt zwar die Erinnerung an Thomas Francks berühmte Frage aus dem Jahr 1970. Doch wankt der völkerrechtliche Eckstein heute so wenig wie seinerzeit. Er bleibt indessen von einer Grauzone umgeben. Diese hat heute eine andere Gestalt als noch 1970, erfasst aber nicht weniger bedeutsames Terrain als damals. So sehr man es auch beklagen mag: Kurzfristig ist eine durchgreifende Aufhellung nicht in Sicht.

Abstract

Who killed Article 2(4)?” Certain instances of recent state practice evoke the memory of Thomas Franck’s almost classic question. Yet, the cornerstone of the international legal order is as firmly positioned today as it was in 1970. Though it remains surrounded by a grey area. This has a different shape today than it did in 1970, but it covers no less significant terrain than it did then. No matter how much one complains: in the short term, a thorough clarification is not in sight.
