Zusammenfassung

EU Anti-Terrorismus-Sanktionen sind ein Extrembeispiel von Grenzauflösung zwischen Innen- und Justizpolitik und Außen- und Sicherheitspolitik sowohl im europäischen als auch im nationalen Kontext, von systematischer Verletzung von Menschenrechten, von Externalisierung von Exekutivmacht auf die internationale Ebene und von vollständig harmonisierten strafrechtlichen Maßnahmen auf europäischer Ebene. Dieser Artikel untersucht und erklärt, inwiefern Anti-Terrorismus-Sanktionen eine Ausnahmeerscheinung sind und welche Faktoren ihr Annehmen durch die EU möglich gemacht haben.

Abstract

EU counter-terrorist sanctions are an extreme example. They exemplify exceptionally well that boundaries between interior and justice policy as well as foreign and security policy are disappearing, both in the European and the national context. Moreover, they provide evidence of systematic violation of human rights, externalization of executive power to the international sphere, and the adoption of fully harmonized EU criminal law. This article examines why counter-terrorist sanctions are an exception and explains what made their adoption in the EU possible.
