Résumé
L’auteur analyse la perspective de créer un Ministère Public européen sur les nouvelles bases juridiques introduites par le Traité de Lisbonne. Une telle initiative devrait s’inspirer des travaux des différents groupes d’experts ayant produit le « Corpus Juris» – pour que « la fiction juridique » se transforme définitivement en réalité institutionnelle judiciaire en Europe.
Abstract
The author analyses the perspective to set up a European Public Prescutor on the new legal basis provided by the Lisbon Treaty. Such initiative should seek some inspiration from the work done by the various expert groups having produced the “Corpus Juris”, so that “legal fiction” can definitely be put into institutional judicial reality in Europe.
