Zusammenfassung

Aufbauend auf ethnographischer Feldforschung in einer Pariser Schuldnerberatung widmet sich der vorliegende Beitrag der Frage, wie in Interaktionen zwischen BürgerInnen und street-level bureaucrats rechtliche Beweise hergestellt werden und welche Rolle Schriftlichkeit bei der alltäglichen Produktion von Recht spielt. Das französische Schuldenregulierungsverfahren fungiert dabei als Beobachtungsposten für die praktischen Konsequenzen der rezenten Transformation des französischen Wohlfahrtstaates, im Zuge derer neue rechtliche Regeln bewusst „offen“ gehalten werden, um sie besser auf die individuellen Lebenssituationen der BürgerInnen abstimmen zu können. Die hier vorgelegte Analyse zeigt, dass diese neue Form sozialen Rechts in der alltäglichen Praxis den Aufwand, die eigenen Lebensumstände zu dokumentieren, deutlich erhöht und dadurch paradoxerweise den Zugang zu Recht erschwert.

Abstract

Drawing on ethnographic fieldwork in a Parisian association for debt counseling, this paper analyzes how public service users and street-level bureaucrats establish evidence of facts during their encounters and discusses the role of literacy in the everyday production of law. The French law of personal bankruptcy appears as a vantage point from which the practical consequences of the recent transformations of the French welfare state can be analyzed, particularly the adoption of laws with deliberately “open texture” in order to offer individualized solutions for citizens. Findings from the present study suggest that this new form of social law increases the efforts public service users have to make in order to document their life circumstances, which, paradoxically makes access to law more difficult.

  1. Wortwörtlich müsste der französische Terminus „procédure de surendettement“ mit „Überschuldungsverfahren“ übersetzt werden. Die vergleichbare Prozedur wird im deutschen Recht „Verbraucherinsolvenzverfahren“, im österreichischen „Schuldenregulierungsverfahren“ genannt. Ich verwende beide Begriffe, ebenso wie die gängige Bezeichnung „Privatkonkurs“.
