The Living Will – Its Legal Status under Austrian Law

Summary

The so-called living will is also an object of controversy in the Austrian legal literature. Especially the question to what extent this kind of advance directive is binding for the physician, the patient’s legal guardian and the court is not yet resolved. Whereas a majority of Austrian legal scholars is of the opinion that an advance refusal of treatment made with capacity simply survives any supervening incapacity, the author proposes that the irreversibly incompetent patient should basically be treated according to what is called an “objective standard”.

Zusammenfassung

Die sogenannte Patientenverfügung ist auch in Österreich Gegenstand judizieller, legislatorischer und rechtswissenschaftlicher Auseinandersetzungen. In welchem Ausmaß der Arzt an solche Verfügungen gebunden ist, ist allerdings nach wie vor strittig. Während eine wohl herrschende Ansicht die Bindungswirkung der Patientenverfügung für den Arzt, den Stellvertreter des Patienten sowie das Gericht recht kategorisch bejaht, vertritt der Verfasser die Meinung, dass der irreversibel einwilligungsunfähige, multimorbide Patient primär entsprechend seinen aktuellen Bedürfnissen behandelt werden soll.
