Berufskrankheit „Meniskopathie“ (Nr. 2102)

Die Berufskrankheit Nr. 2102 ist eine „alte“ Berufskrankheit. Sie datiert aus einer Zeit, zu der eine Dosis-Wirkung-Beziehung, wie sie § 9 SGB VII an die Kodifizierung einer Berufskrankheit stellt, dafür noch nicht Voraussetzung war. Eine Dosis-Wirkung-Beziehung – als Voraussetzung daraus resultierender Beweiserleichterungen – kann deshalb auch bei der Umsetzung der Berufskrankheit nach Nr. 2102 nicht unterstellt werden. Versichert ist die anatomische Einheit „Menisken“. Die „Meniskopathie“ ist abzugrenzen von der alterskorrigierten Norm, von Unfallfolgen und von sekundären Meniskusschäden (Folgeschäden). Die meniskusgefährdende berufliche Exposition sind die rauhe Bewegungsbeanspruchung und die belastete Zwangshaltung. Der Belastungszusammenhang zwischen – im Vollbeweis zu sichernder – Meniskopathie und – im Vollbeweis zu sichernder – beruflicher Exposition setzt das belastungskonforme Schadensbild und den belastungskonformen Verlauf voraus. Die Einschätzung der MdE hat sich der modernen Operationstechnik anzupassen.

Occupational illness no. 2102 is an “old” one. It dates from a time when a dose–effect link such as is specified in § 9 SGB VII on codification of an occupational illness was not yet a condition for its classification as such. A dose–effect relation – as a precondition of resultant aids to documentation – cannot therefore be assumed even in the realization of occupational illness after no. 2102. Insurance covers the anatomical unit “menisci”. Disease of a meniscus or of menisci must be differentiated from the age-corrected norm, from the sequelae of accidents and from secondary meniscus injuries. The aspects of occupational exposure that put the menisci at risk are the extreme stress during movement and the constrained posture that has to be maintained while supporting heavy loads. The connection between stress-induced menisceal disease and occupational exposure – both of which must be certified with full documentation – is conditional on a disease picture that is consistent with heavy loading of the joint and a course of illness that is also consistent with such loading. Appraisal of the reduction of earning capacity must take account of modern surgical techniques.
