Zusammenfassung
Die gutachterliche Beurteilung unmittelbarer, aber auch langfristiger Unfallfolgen erfordert häufig die Einordnung von Beinschwellungen. Diese stellt eine diagnostische Herausforderung dar und macht eine angiologische bzw. phlebologische Zusatzbegutachtung notwendig. Nicht selten ist ein postthrombotisches Syndrom nachzuweisen. Neben der klinischen Einschätzung sind diagnostische Verfahren wie die venöse Verschlussplethysmographie, die Phlebodynamometrie und vor allem die farbkodierte Duplexsonographie zur Beurteilung des Schweregrades und zur Objektivierung funktioneller Einschränkungen essenziell. Aufgabe des Gutachters ist es, die haftungsausfüllende Kausalität vor allem bei großer zeitlicher Latenz zwischen Unfallzeitpunkt und Gutachtenerstellung zu begründen. Naturgemäß bedarf es dazu neben der gefäßmedizinischen Expertise fundierter Kenntnisse relevanter Unfallmechanismen sowie der Behandlungsmethoden. Im Gegensatz zur üblichen traumatologischen Bewertung ist eine allgemeingültige Bemessungsgrundlage nicht immer anwendbar, sodass der individuellen Bewertung nach dem Sozialrecht, aber auch berufsgenossenschaftlichen und versicherungsrechtlichen Aspekten durch den Gutachter eine hohe Verantwortung zukommt.
Abstract
An expert evaluation of the immediate and long-term effects of an accident frequently requires a classification of leg swelling. This constitutes a diagnostic challenge and calls for an additional angiological and/or phlebological evaluation. Postthrombotic syndrome is not infrequently detected. In addition to a clinical evaluation diagnostic procedures, such as venous occlusion plethysmography, phlebodynamometry and, above all, colour-coded duplex sonography are essential for assessing the severity and in objectifying functional limitations. The expert’s goal is to account for the contributory cause, particularly when there is a longer latency period between the time of the accident and the drawing up of the expert report. In addition to vascular medical expertise, there naturally needs to be a sound understanding of the relevant accident mechanisms and treatment methods. In contrast to conventional trauma assessments, a universally valid measurement scheme is not applicable so that great importance is placed on an individual assessment by the expert that is in line with social legislation, as well as insurance aspects and aspects of the German employer’s liability insurance association.
