Begründungen sind ein notwendiger Bestandteil von Gutachten. Sie können mit Grundsätzen der deduktiven Logik einerseits analysiert, andererseits planmäßig konstruiert werden. Auch die Suche und Vermeidung von Begutachtungsfehlern lassen sich durch eine Anwendung logischer Prinzipien verbessern. Damit Begründungen ihre Funktion als Erklärungen von Beurteilungen angemessen erfüllen können, sollten sie beim Gutachtenaufbau in systematischer Weise berücksichtigt werden.

Abstract

Supporting arguments are essential elements of expert reports. On the one hand they can be analysed according to the rules of deductive logic, while on the other they can be structured in a formal manner. Application of the principles of logic can also be helpful in the search for errors in the evaluation and in the avoidance of such errors. To ensure that supporting arguments fulfill their function as explanations of expert opinions adequately, they should be systematically considered when the report is drawn up.
