Zusammenfassung
Der Beitrag zeigt, dass Art 2 Abs 3 und Art 3 B-VG in der mit der B-VG-Novelle BGBl I 2/2008 geltenden Fassung zu einer wesentlichen Klarstellung geführt haben: Die Länder sind nun in ihrem Bestand dadurch abgesichert, dass jeglicher bundesverfassungsrechtliche Eingriff, der das Wesen ihres territorialen Bestands betrifft, an Verfassungsgesetze der betroffenen Länder geknüpft ist. Aber auch in materieller Hinsicht sind die „selbstständigen Länder“ insoweit „gesamtänderungsfest“ als eine Beseitigung oder entscheidende Schwächung ihrer „Selbständigkeit“ ebenso eine Änderung im Bestand dieses Landes darstellt.
Darüber hinaus bringen die neuen Bestimmungen über Grenzänderungen einige wesentliche Neuerungen, die auf Bundesebene zu einer gewissen Verfassungsbereinigung führen. Wie Grenzänderungen auf Landesebene abgewickelt werden, wird von der Bundesverfassung weitgehend den Ländern überlassen, sie können, müssen aber nicht das erleichterte Verfahren übernehmen.
Abstract
This paper shows that Art 2 par 3 and Art 3 of the Federal Constitution in the valid amended version (BGBl. I 2/2008) has led to a substantial clarification: The states (Länder) are guaranteed in their existence by the fact that any federal constitution-legal interference, concerning the nature of their territorial existence, depends on constitutional laws of these states.
In addition, the “independent states” are insofar protected in respect of a total revision of the Federal Constitution as a removal or a crucial weakening of their “independence” would mean likewise a change in the existence of this member state. The barrier, how far the Federal Constitution is allowed to intervene in the existence of the states may lie at serious impairments of the federal principle of the constitution. Such impairments would have to be qualified as challenges of the state quality of a member state.
Furthermore the new regulations concerning border modifications are bearing some substantial innovations, which lead on federal level to a certain clearing of the widespread Austrian constitutional law.
The implementation of modifications of the borders on state level is extensively left to the member state by the Federal Constitution.
