Patientenverfügung, Autonomie und Relativismus

Zusammenfassung

Mit der Patientenverfügung bestimmt der Patient über seine aktuelle Einwilligungsfähigkeit hinaus, welche Behandlung ihm zuteil oder nicht zuteil werden soll. Die moralische Rechtfertigung dieser Einrichtung basiert hauptsächlich auf der Vorstellung, dass die individuelle Autonomie des Patienten nur dann gewahrt ist, wenn er, und nur er selbst, über medizinische Eingriffe bestimmen darf. Nicht alle Kulturen räumen der individuellen Autonomie jedoch einen solch zentralen Stellenwert ein. In diesem Aufsatz gehe ich der Frage nach, ob hier eine relativistische Sichtweise angemessen ist. Ich werde eine (moderat) positive Antwort vorschlagen, also einen (gemäßigten) moralischen Relativismus verteidigen.

Abstract

Definition of the problem

The purpose of an advance directive is to enable the patient to decide which medical treatment to receive after his actual ability to consent has vanished. The moral justification of this institution mainly rests on the idea that the individual autonomy of the patient only remains intact as long as he – and only he – is allowed to decide about his medical treatment. However, not all cultures value individual autonomy that high.

Arguments and conclusion

In this paper I will discuss the question whether or not a form of moral relativism is the adequate response to this fact. I am going to give a (moderately) positive answer to this question, that is: I am going to advance a moderate form of moral relativism.
