Zusammenfassung

Zwei tödlich verlaufene Fälle von Aortendissektion Typ A werden dargestellt. Im ersten Fall wurde eine Befunderhebungsmangel festgestellt und aufgrund der Beweislastumkehr Schadensersatzansprüche bejaht. Im zweiten Fallbeispiel konnte keine Verletzung der Sorgfaltspflicht nachgewiesen werden, weshalb Schadensersatzansprüche entfielen.

Abstract

Two cases of acute aortic dissection type A with lethal outcome are described. In one case, the final diagnostic examination was omitted which was regarded as a grave mistake. Thus, the burden of proof shifted to the doctors and compensation was agreed to. In the second case, there was no agreement to a medical malpractice. Therefore, compensation was denied.
