X-ray diagnostic without medical indication and bodily harm: decision of the Supreme Court of Germany 3/12/97 – 2 StR 397/97

Abstract.

An orthopedic surgeon had been condemned for different offences to 2 years and 6 months imprisonment by the superior court in Frankfurt/Main. One point of the ruling had been the use of X-rays without medical indication, which the superior court of Frankfurt/Main finally did not assess as bodily harm. The supreme court of Germany overruled this interpretation and referred the case back for a new trial and ruling.
