Psychiatrische Kriterien zur Beurteilung der Einwilligungsfähigkeit

Abstract

Every day each physician has to assess a patient’s capability to consent to medical treatment. This paper illustrates the legal term “capability to informed consent” and proposes psychopathological criteria to assess this capability. It is not possible to make this conditional to certain psychiatric diagnoses, but to some relevant symptoms. These symptoms are qualified to indicate the inability to understand, to process and to value the crucial information or the inability to determine or to express his personal will.

Zusammenfassung

Die Beurteilung der Einwilligungsfähigkeit eines Patienten ist ständige ärztliche Aufgabe. In diesem Beitrag werden nach Erläuterungen zum Rechtsbegriff „Einwilligungsfähigkeit“ psychiatrische Kriterien dargestellt, anhand derer in fraglichen Fällen das Vorliegen dieser Fähigkeit zu überprüfen ist. Erläutert werden Symptome, an denen zu prüfen ist, ob ein Patient über die Fähigkeit verfügt, einen bestimmten Sachverhalt zu verstehen, diese Informationen in rationaler Weise zu verarbeiten sowie angemessen zu bewerten und ob er die Fähigkeit besitzt, den eigenen Willen auf der Grundlage von Verständnis, Verarbeitung und Bewertung der Information zu bestimmen und zu äußern.
