Der mit dem Begriff “Sterbehilfe” umschriebene Problemkreis hat Mediziner, Moraltheologen, Ethiker und Juristen immer wieder nachhaltig beschäftigt. Die dazu erschienene Literatur ist kaum noch übersehbar, die Meinungen sind vielfältigst differenziert und selbst in grundsätzlichen Fragen durchaus unterschiedlich. Der Ruf nach dem Gesetzgeber wurde daher wiederholt – allerdings vergeblich – erhoben. Alles dies kann angesichts der Komplexität der Materie und der weltanschaulichen Gebundenheit vieler Antworten nicht verwundern. Deshalb wird es sicherlich auch niemanden überraschen, dass die Rechtsprechung die Grenzen zwischen strafbarer und straffreier Sterbehilfe, zwischen Tötungsverbot und Selbstbestimmungsrecht des Sterbenden nicht messerscharf zu ziehen vermocht hat und die strafrechtliche Beurteilung der unterschiedlichen Fallgruppen gewisse Wertungswidersprüche aufweist, wie die zahlreichen Urteilsbesprechungen deutlich machen.
Abstract
Euthanasia and related issues have long been important subjects for debate among physicians, theologists, ethicists, and lawyers. The literature on the topic has become quite voluminous, with varied and differentiated opinions that may differ even in the most basic principles. Many have therefore hoped for new laws to regulate issues surrounding euthanasia, however, this hope has not yet been fulfilled. In light of the complexity of the issues and the importance of religious and moral beliefs in the formation of opinions on this topic, the lack of a consensus is not surprising. It is therefore also not surprising that there is no unambiguous legal border beyond which euthanasia becomes a punishable offense, and there is no legal answer to the conflict between the obligation of physicians not to kill and the right of the dying to self determination. Similarly, legal judgments in different groups of cases involving euthanasia have often been contradictory with respect to moral values, as is reflected in numerous legal opinions.
