Zusammenfassung

Die Behandlung minderjähriger Patientinnen wirft besondere Fragestellungen und Probleme auf. Die Minderjährige kann selbst keinen wirksamen Behandlungsvertrag abschließen, was für die Behandlung von minderjährigen Privatpatientinnen bedeutsam ist. Sie kann aber sehr wohl bei Einsichtsfähigkeit in die Behandlung einwilligen, wobei eine Abstufung in die Altergruppen unter 14 Jahren, 14 bis 16 Jahre und über 16 Jahre praktische Bedeutung hat. Kontrazeptiva sollten Mädchen unter 14 Jahren nur mit Einverständnis der Eltern verordnet werden, ab 16 Jahren kann die Patientin im Allgemeinen selbst entscheiden und bei Patientinnen zwischen 14 und 16 Jahren muss der Einzelfall beurteilt werden. Grundsätzlich besteht die ärztliche Schweigepflicht gegenüber den Eltern der Patientin, wenn diese nicht in die Mitteilung einwilligt und die Information der Eltern nicht erforderlich ist, um das Wohl der Minderjährigen zu wahren. Die Minderjährige hat ein Vetorecht bei operativen Eingriffen und Behandlungsmaßnahmen. Für einen Schwangerschaftsabbruch ist die Einwilligung der Eltern erforderlich, wenn die Schwangere unter 16 Jahre alt ist. Sterilisation und Organlebendspende (Spenderin) sind bei Minderjährigen grundsätzlich unzulässig.

Abstract

The underage patient in the practice setting creates several problems with respect to legal matters. She cannot make a contract on her own, which is important for private patients, but she is allowed to decide on medical treatment depending on her personal capabilities. We discriminate according to age the groups under 14 years old, 14-16 years old and above 16 years of age. Contraceptives should not be prescribed to girls under 14 years old without informed consent of the parents, but from 16 years old the patient can decide on her own. Between 14 and 16 years the patient may be able to decide on her own, depending on individual case circumstances. In general the doctor is not allowed to inform the parents unless the patient agrees or the information to the parents is necessary to avoid hazards for the patient, but medical confidentiality must be upheld. The underage patient cannot be forced to agree to operative interventions. In cases of pregnancy termination the patient may decide on her own when she is 16 years or older. Sterilization and organ donation (live donor) are not allowed in underage patients.
