Strafrecht, psychologie en wetenschap: over Mooij’s Toerekeningsvatbaarheid

Samenvatting

Forensische psychiatrie staat in Nederland betrekkelijk in de kinderschoenen. Met name omtrent toerekeningsvatbaarheid is vanuit psychologische en psychiatrische hoek weinig ondernomen om het concept een wetenschappelijke inbedding te geven. Deels is dit toe te schrijven aan het feit dat de forensische psychiatrie in Nederland is ondergebracht bij de rechtenfaculteiten. Hierdoor is er weliswaar veel onderzoek gedaan hoe de psychiatrie een bijdrage kan leveren aan juridische vragen, maar is er relatief weinig werk verricht op het gebied van paradigmavorming ten behoeve van een forensische psychiatrie en een psychologische invulling van toerekeningsvatbaarheid.
