The Woolf report and German civil procedure

Conclusions

A close look at English and German civil proceedings reveals that there are a number of common problems, but also some common solutions to these problems, despite the fact that the two legal systems have such very distinct judicial traditions. The aim of creating a judicial system which offers easy access to justice, pursuant to a procedure which is transparent and comprehensible to the population as a whole, has not yet been reached in the two countries. Lord Wolfs proposals represent an important step forward towards this common goal. The German government will be well advised to take account of the experience of the legal system of England and Wales in its future efforts to reform its own judicial system.
