Die Rolle des Bundesamtes für Umweltschutz auf dem Gebiet der Lärmbekämpfung

Zusammenfassung

Die staatliche Lärmbekämpfung wird vom Bund, von den Kantonen und den Gemeinden gemeinsam getragen. Seit der Verankerung eines Umweltschutzartikels in der Bundesverfassung ist der Bund in erster Linie für die Gesetzgebung, die Kantone und Gemeinden für den Vollzug zuständig. Das Bundesamt für Umweltschutz koordiniert die Aktivitäten auf Bundesebene. Die wichtigsten derzeitigen Aufgaben sind: Vorbereitungen von Rechtsvorschriften, Beratungen anderer Behörden, Begutachtungen konkreter Anlagen, Information der Öffentlichkeit und Vorbereitungen für die künftige Ausbildung von Fachbeamten.

Au niveau de l'Etat, la lutte contre le bruit est assumée en commun par la Confédération, les cantons et les communes. Depuis l'introduction dans la Constitution fédérale d'un article sur la protection de l'environnement, la Confédération est chargée en premier lieu de légiférer en la matière, alors que les cantons et les communes seront chargés de l'application de la loi. L'Offfice fédéral de la protection de l'environnement coordonne les activités au niveau de la Confédération. Les tâches actuelles les plus importantes sont de préparer des prescriptions légales, de fournir des conseils aux autres autorités, de préaviser sur les projets de nouvelles installations, d'informer le public et de veiller, à l'avenir, à la formation des fonctionnaires chargés de la lutte contre le bruit.

Summary

The public efforts in noise abatement are shared among federal, cantonal, and local authorities. Since the acceptance of a new article in the Federal Constitution concerning the protection of the environment, the federal authorities have primarily the task to prepare and issue regulations, whilst the cantonal and local authorities have to enforce them. The Federal Office for Environmental Protection has to coordinate the activities at the federal level. The main present tasks are the preparation of new regulations, to act as an advisory board for other authorities, to analyse and evaluate the noise impact of installations and facilities, to inform the public, and to prepare the future education and training of the executive officials.
