Summary
The difference between treatment and experimentation does not lie in the uncertainty of the result, but in not following a standard procedure. Experimentation in surgery should be encouraged if the new procedure is scientifically sound, if there is an acceptable riskbenefit ratio, if the patient has given his informed consent, and if an ≫ethical committee≪ has been asked. The small number of cases suggests that experimentation in surgery seldon ends up in court.
Zusammenfassung
Der Unterschied zwischen Behandlung und Versuch liegt nicht in der Unsicherheit des Ergebnisses, sondern darin, daß von einer Standardmethode abgewichen wird. Chirurgische Forschung ist zu ermutigen, wenn das Projekt wissenschaftlich zweckmäßig, das Verhältnis von Vorteil and Gefahr annehmbar und die Zustimmung nach Aufkldrung des Patienten gegeben ist. Auch sollte nach Möglichkeit eine Ethikkommission mit dem Projekt befaßt werden. Die geringe Zahl von Gerichtsentscheidungen deutet darauf hin, daß Gerichte selten wegen nicht erfolgreicher Forschung angerufen werden.
