“Mentally disordered offender” is an umbrella term that consists of persons (1) found to be incompetent to stand trial; (2) found to be not guilty by reason of insanity; (3) found to be a mentally disordered sex offender; or (4) administratively transferred from a prison to a mental hospital. While this term has gained some acceptance in the literature, it is not an entirely accurate description. Neither incompetent defendans nor persons acquitted by reason of insanity have been convicted of a crime. Thus, neither group technically includes “offenders”.
