Abstract

This paper provides an overview of an emerging and important trend in modern penality, the punishment of persistent offending. It argues that what lies behind this new development is a merger of the right to protection (itself an overarching theme of penal policy) and the implications for risk management of shifting political rationalities in the last two decades.
