Zusammenfassung

Das Kapitel beschäftigt sich mit der Geschichte von Frauen vor und im Gericht im 19. und 20. Jahrhundert in Europa. Während die Rechtskodifikationen der Aufklärung in der Regel die Abschaffung der Geschlechtsvormundschaft regelten, hatten sie gleichzeitig eine eheliche Vormundschaft eingeführt. So besaßen verheiratete Frauen im Gegensatz zu unverheirateten Frauen und Witwen bis zu unterschiedlichen Graden in allen europäischen Rechtskodifikationen nur eine eingeschränkte Rechtsfähigkeit. Die verschiedenen Gesetze wirkten oft auf komplizierte Art zusammen, um die Diskriminierung der Frauen im Recht aufrecht zu erhalten. Verheiratete Frauen waren durch das Zivilrecht einerseits und die fehlenden politischen Rechte anderseits im Recht des 19. bis zum 20. Jahrhundert rechtlich eingeschränkter als in der frühen Neuzeit mit seinem rechtlichen Pluralismus.

Dies schlägt sich auch in der Situation von Frauen vor und im Gericht nieder. Der Artikel widmet sich nach einem Überblick über die Rechtsposition von Frauen und dem Kampf der Frauenbewegung um gleiche Rechte schwerpunktartig der Situation der verheirateten Frau vor Gericht, der Frau als Schöffin, Geschworene und Richterin sowie der Frau als Rechtanwältin.
