Abstract

The Austrian Constitution, as it is in force today, dates back to October 1, 1920. It was the result of a revolutionary development but incorporates also elements of the previous constitutional monarchy. By a reform of 1929, the position of the federal president was strengthened. Austria is a Federal Republic but the competences of the nine federal countries are rather limited.

Austrian constitutional law is not contained in one single document but has, as to its structure, a multilayered, diffuse nature. There are over 1.000 provisions in the Austrian legal order which have constitutional rank. This constitution was originally designed by Kelsen in 1920 to lay down only the “rules of the game” (“Spielregelverfassung”), i.e., to provide neutral norms for the functioning of the constitutional order, but in the meantime this proposition has been partly abandoned. A comprehensive catalogue of fundamental rights is still lacking in the Austrian constitutional system.

Austria joined the European Union in 1995, and therefore at a rather late stage of the European integration process. The process of adapting the Austrian legal order to the exigencies of EU law is still ongoing. Austria understands itself as a neutral country even though it is doubtful whether this official understanding is compatible with EU law. Calls for far-reaching constitutional and legislative reforms dominate the political discussion in this country.
