Treatment versus Punishment for Drug Addiction

Abstract

In Austria, a restrictive but treatment-oriented approach is applied to the handling of illegal narcotics and psychoactive substances and drug-addicted offenders. While on the one hand the handling of illegal drugs is broadly criminalized, on the other, in each stage of criminal proceedings, exit strategies towards quasi-compulsory treatment instead of punishment are provided. The present chapter describes the legal situation in Austria. Both the historical development and present scope of drug offenses and the legal and medical parameters for quasi-compulsory treatment of drug-addicted offenders are explained.
