The Universal Approach of the United Nations Convention Against Corruption

Abstract

The chapter focuses on the United Nations Convention Against Corruption (UNCAC), the main legal instrument adopted internationally in order to combat corruption. The chapter considers the impact of corruption in society in relation to both the public and the private sector. Many aspects of the UNCAC are covered, and comments are provided in particular on Article 12, which calls on states parties to prevent corruption, and on Article 26, which binds states to establish criminal, civil, or administrative liability of legal persons. In addition, the chapter highlights how preventive actions in the private and the public sector represent a key driver for change. Finally, the chapter illustrates the measures on which the UNODC, the Organization for Economic Cooperation and Development (OECD), and the World Bank are working, indicating the projects aiming at reducing vulnerabilities to corruption in the public procurement system, and creating legal incentives for corporate integrity and cooperation.
