Abstract

As information technology develops, the control of privacy becomes practically more complicated day after day. The absence of efficient regulations and effective enforcement of laws can cause serious issues, for instance, as the Edward Snowden revelations have indicated. Privacy issues and concerns have increased after Snowden leaked secret information from the US National Secret Agency (NSA) that the USA has privately served a number of surveillance programs, even against supposed allies. Consequently, people have started to demand their rights to privacy and family life and to force their governments to protect their personal data from being disclosed or used without their consent. Accordingly, in EU, the General Data Protection Regulation came into force to provide efficient protection for privacy and personal data. Considering the General Data Protection Regulation, Turkey amended its Constitution, Civil Code, and Penal Code and has provided several specific regulations on rights to privacy and personal data protection. This work questions the Turkish Constitution, Civil Code, and Penal Code to analyze whether sufficient and robust regulation is in place to protect privacy and personal data, taking relevant social media and PTT (post, and telegraph organization) cases into account. It proposes that legislations guaranteeing the protection of privacy and personal data must be updated in line with the development of information technology.
