The Genesis and the Current State of Domestic and Foreign Legal Thought in Countering Extremism in Penal Institutions as a Manifestation of Liberal Economic Processes

Abstract

This paper is concerned with the study of the issues of emergence and development of scientific thought of domestic and foreign legal experts on the issues of combating and preventing the proliferation of various manifestations of radicalism in bodies and institutions of custodial sentence. The relevance of this topic is due to the increase in the incidence of various manifestations of extremism in places of detention over the past two decades and the need to develop effective measures to counter this phenomenon. The paper presents a generalized description of the main lines of development of modern theories and practices of countering penal extremism. Based on the comprehensive content analysis of studies dealing with issues of radicalization of convicts, as well as the publication activities of domestic and foreign scholars and expert community, the periodization of the main stages of development of legal thought and research activities in the field under consideration was offered. Based on the analysis of legal thought in countering extremism in penal institutions, we can conclude that despite the growing interest of many scholars in the study of the issues of countering penal extremism, many aspects of this topic are still understudied and require further consideration, and a further comprehensive study of methodological, organizational and organizational framework for countering extremism by bodies and institutions of the Russian penal system as one of the ways of ensuring national security of the state should serve as the vector of this work.

The authors of this paper, for the first time ever, used a set of scientific methods to analyze measures aimed at deradicalization of prisoners in the Scandinavian countries. Practical relevance: fundamental principles and findings of the paper can be used in scientific and academic activities when considering conceptual issues of countering extremism. Information in this paper can be of practical importance for the elaboration of measures of deradicalization of persons sentenced to imprisonment relating to the domestic penal system.
