Abstract
The Diciotti case is a test of constitutionalism itself, that is the legal civilisation built after the tragedies of the first half of the twentieth century. Is the Italian Senate’s assessment free from legal constraints or, in case the authorisation to prosecute is denied, there will be “a judge in Berlin”?
