Of the five earlier cases, only three proceeded to judgment (Case 141/78 France v United Kingdom [1979] ECR 02923, Case C-388/95 Belgium v Spain [2000] ECR I-03123, and Case C-145/04 Spain v United Kingdom [2006] ECR I-07917).
