Zugangsregulierung zu genetischen Ressourcen und der Schutz traditionellen Wissens

Zusammenfassung

Die BIC-Staaten gehören zu den sogenannten Megabiodiversitätsländern und verfolgen mit Nachdruck das Ziel, ihre genetischen Ressourcen und das mit ihnen verbundene traditionelle Wissen gegen den unkontrollierten Zugriff und die kompensationslose kommerzielle Nutzung durch Externe zu sichern bzw. diesen international über viele Jahrzehnte ungeregelten Wissensbereich zu einem Bestandteil des internationalen Schutzsystems geistiger Eigentumsrechte zu machen. Die Fallstudie dient der empirischen Überprüfung der aus dem Modell der globalen Wissensstruktur abgeleiteten Hypothesen, die die Position eines Staates in der Struktur in Beziehung setzen zu seinem Vermögen, Einfluss auf die globale Regulierung geistigen Eigentums auszuüben. Die Strategien des Forum-shifting und der Nationalisierung dienen als Analyseraster für die Untersuchung und verdeutlichen wie, d.h. auf welche Art und Weise die BIC-Staaten versuchen, ihre Interessen in der Form struktureller Veränderungen im Bereich der globalen Regulierung geistigen Eigentums durchzusetzen.
