Zusammenfassung
Eigentum verpflichtet – und mit geistigem Eigentum geht Verantwortung für das produzierte Wissen einher. Das Konzept der Autorisierung ermöglicht, einen genuin soziologischen Zugang zum geistigen Eigentum zu entwickeln und damit neue Gesichtspunkte in eine für den fortgeschrittenen Wissenskapitalismus zentrale Debatte einzubringen. Diese Konzeption basiert auf der Beobachtung, dass Wissen und Wissensgüter – wie zum Beispiel Medikamente – in ihrer Qualität für die Nutzer im Voraus oftmals schwer oder gar nicht zu beurteilen sind. Daher besteht vonseiten der Konsumenten ein Bedürfnis nach Autorisierung, d. h. nach Zuschreibung von Verantwortung. Dieses Bedürfnis richtet sich nach dem Ausmaß der Unsicherheit und besteht unabhängig davon, ob ein Autor oder eine Firma für das Wissen ein geistiges Eigentum beansprucht, worauf sich die bisherige Debatte allein fokussiert. Von dieser Annahme ausgehend untersucht der Beitrag, wie sich Autorisierung im sozialen Feld des Wissens vollzieht: Umkämpft ist nicht nur, ob Wissen kommerziell oder öffentlich ist, sondern auch, wie stark die Definitionsmacht hierarchisch monopolisiert oder egalitär verteilt werden soll. Am Beispiel der Autorisierung von Saatgut, einer für die menschliche Existenz elementaren wirtschaftlichen Ressource, soll diese Betrachtungsweise veranschaulicht werden.
Abstract
Property obliges—and intellectual property entails responsibility about the knowledge produced. The theoretical concept of authorization enables the development of a genuinely sociological perspective of intellectual property. Based on this perspective of intellectual property, it is possible to introduce new aspects in the current and for the advanced knowledge capitalism central debate. The concept of authorization is based on the observation that—from the perspective of knowledge users—it is very difficult (if not impossible) to assess in advance the quality of knowledge and knowledge goods, like for example drugs. This uncertainty entails the consumers’ demand for authorization for an attribution of responsibility. The need of authorization is caused by the extent of insecurity and it exists independently from the aspiration of intellectual property by a company or person (for the time being, the debate struggles only with the last problem). Starting from there, the article examines the question how authorization is being established in the social field. Thereby, it is not only contentious whether or not knowledge should be commercialized or is open access. It is also contentious to which extend the power of definition should be hierarchically monopolized or egalitarianly distributed. The theoretical perspective will be illustrated with a case study on the authorization of seed—the latter being an economic resource which is of elementary importance for human life.

La propriété oblige – de même, la propriété intellectuelle va de pair avec une responsabilité pour les connaissances produites. Le concept d’autorisation permet d’aborder la question de la propriété intellectuelle sous un angle spécifiquement sociologique et d’éclairer ainsi de nouveaux aspects dans un débat crucial pour l’économie de la connaissance avancée. Ce concept est basé sur l’observation qu’il est difficile, voire impossible aux utilisateurs de porter un jugement préalable sur la qualité des connaissances et des produits de la connaissance à leur disposition, comme par exemple les produits pharmaceutiques. C’est pourquoi il existe chez les consommateurs un besoin d’autorisation, c’est-à-dire d’attribuer une responsabilité. Ce besoin est fonction du degré d’incertitude des consommateurs et indépendant de la question de savoir si un auteur ou une entreprise fait valoir des droits de propriété intellectuelle sur les connaissances en question, point sur lequel s’est jusqu’à présent concentré le débat. Partant de cette hypothèse, cet article analyse les procédés d’autorisation dans le champ social de la connaissance. L’objet du débat n’est pas seulement de savoir si la connaissance appartient au secteur public ou privé, mais aussi dans quelle mesure le pouvoir de définition doit être monopolisé hiérarchiquement ou partagé également. Cette approche est illustrée ici à partir de l’exemple de l’autorisation des semences, une ressource économique fondamentale pour l’existence humaine.

Unsere eigenen empirischen Feldstudien zur Saatgutbranche beziehen sich dabei auf Saskatchewan in Kanada (Schubert et al. 2011; Schubert 2007) sowie gegenwärtig auf Deutschland und den deutschsprachigen Raum (Brandl 2012; Brandl i. E.; Böschen et al. i. E.; Schneider und Gill i. E.). Sie beruhen auf bisher 52 Experteninterviews, der Teilnahme an Konferenzen, Dokumentenanalysen sowie der quantitativen Auswertung von Sortenschutzanmeldungen und Patentdaten. Interviewpartner waren Saatgutzüchter, Biotechnologen, Forschungsmanager und Patentanwälte von großen Unternehmen, Mitarbeiter von Bundes- und Landesbehörden, Mitarbeiter von Branchenverbänden, Saatgutvermehrer, Saatguthändler und Landwirte.
Anknüpfungspunkte ergeben sich auch in der „Cultural Theory“ von Mary Douglas (1982): „öffentlich versus kommerziell“ entspricht dort der group-Dimension, „autoritär versus egalitär“ (= „zentral versus dezentral“) korrespondiert mit der grid-Dimension.

Der Herfindahl-Hirschman-Index ist die Summe aller quadrierten Marktanteile der Wettbewerber eines Marktes, wobei ein gegen Null strebender Wert vollständige Konkurrenz und ein Wert von 100 % ein vollständiges Monopol anzeigt.
